Gangrape during dacoity: Each of 5 accused gets 60 years' jail

A court in Chattogram on Thursday awarded double life-term jail sentences to five accused in a case involving gang rape while committing dacoity.

As a result, each of the accused will have to stay in jail for 60 years.

Besides, an accused was acquitted from the case.

The five convicts gang-raped four women while committing dacoity at the home of an expatriate at Karnafuli area in Chattogram.

Judge Md Moinuddin of the Women and Children Repression Prevention Tribunal-6 of Chattogram delivered the verdict on Thursday afternoon. After the delivery of the judgement, four convicts were taken to jail, while another convict--Md Ilyas alias Sheikh Sumon--has been absconding.

The convicts were Abu Shyama, Mizanur Rahman alias Mizan Matbar, Maidul alias Mohibul, Zahirul Islam Howlader and Md Ilyas alias Sheikh Sumon, while the acquitted accused was Abdul Hannan alias Hannan Member.

Tribunal's public prosecutor Advocate Nazrul Islam Sentu said five accused were awarded life-term jail sentence and fined Tk 1 lakh each for gang rape. At the same time, each of the five accused was awarded life-term jail sentence and fined Tk 50,000 for dacoity. "We'll appeal to the higher court against the acquitted accused," he said.

The case statement says that after midnight on December 12, 2017, the convicts went to a house at village Shah Mirpur under Baro Uthan union in Karnafuli to commit dacoity. Then they gang raped four women at the house one after another intimidating them at gunpoint. Of the four women, three were the wives of three expatriate brothers, while the other was younger sister of the expatriates.

The dacoits also looted gold jewelries, five mobile phones and other valuables from the house.

After allegations were raised against police that they had been playing dally-dillying in registering the case, the Karnafuli Police Station subsequently recorded the case at the directive of the then State Minister for Land Saifuzzaman Chowdhury Javed on December 17--five days after the incident. The court also showcaused Karnafuli Police Station OC for dally-dillying in registering the case. However, subsequently, Police Bureau of Investigation (PBI) took over the charge of the case on December 26 of that year at the directive of the headquarters.

Later, police arrested three accused. The PBI's investigation officer Santosh Kumar Chakma submitted chargesheet to the court on September 3 in 2019 after probing the case.

It has been mentioned in the chargesheet that the convicts had gang raped four women while committing dacoity as per the plan of Karnafuli's local inhabitant Abu Shyama. Five dacoits entered the house cutting the window grills, while Abu Shyama had guarded the house staying outside. There were two women in a room, while two other women were at the adjacent room. There were no male at the house. The dacoits committed dacoity at the gun-point intimidating the women. At one stage, they gang raped the women one after another.
