HC issues contempt rule against RDCD secretary

The High Court issued a contempt of court rule against the Secretary of the Rural Development and Co-operatives Division under the Ministry of Local Government and Rural Development for violating its order over dismissal of PDBF MD.
In the rule, the court asked the Secretary to explain in two weeks why contempt of court proceedings should not be brought against him for not implementing its previous order.
The HC bench comprising Justice Sheikh Hassan Arif and Justice Sardar Md. Rashed Jahangir issued the rule following a contempt petition filed by Madan Mohan Saha, former acting managing director and Executive Member of Palli Daridra Bimochon Foundation (PDBF).
Senior lawyer MK Rahman and lawyer Sabyasachi Mondal appeared for the  petitioner.
Petitioner's lawyer Sabyasachi Mondal said following a writ petition filed by former PDBF MD Madan Mohan, the court on May 26 this year stayed the decision of 74th board meeting decision of PDBF.
The HC also issued a rule as to why placing of agenda by the respondent and decision taken pursuant to the said agenda of its board meetings held on February 27 and May 19, this year should not be declared illegal.
The then-secretary of the RDCD Md. Kamaluddin Talukder, an ex-officio chair of the board, chaired the meeting and decided to remove the Madan Mohan from his position.
Later, he issued a termination letter to the petitioner.
Later on behalf of RDCD, the state filed an appeal against the HC order. On September 16 this year, the Appellate Division of the Supreme Court rejected the appeal.
As a result, the top court upheld the HC order.
As the respondents did not take any measures to uphold HC order, the petitioner lodged the contempt petition against the respondent.
Earlier on August 7 this year, the petitioner served a legal notice for violating the HC order.
