The Appellate Division of the Supreme
Court on Thursday upheld a order of the chamber court that earlier cancelled the candidature of Narayanganj's Rupganj Upazila Parishad chairman candidate Salim Prodhan.
At the same time, the top court
fined Tk 10,000 to Salim Prodhan, for wasting court time by not operating a petition after filing it.
An eight-member Appellate Division bench, led by Chief Justice Obaidul Hasan, passed the order and fined the money.
Adv AKM Nurul Alam was in the court for Salim Prodhan, while Barrister Khan Mohammad Shammi Aziz and Barrister Ashfaqur Rahman were present on behalf of the Election Commission.
Before holding hearing on a petition filed earlier by Salim Prodhan's lawyer, Nurul Alam requested the court for non-prosecution of his petition (not to continue his case). The Appellate Division then said, "Considering your emergency, the petition has been brought to the hearing list. Now, you said for non-prosecution. Everything must have a limit."
After that, the court fined alleged casino kingpin Salim Pradhan Tk 10,000.
The Supreme Court chamber judge issued status quo on May 2 on a High Court order that directed the Election Commission to allocate election symbol and allow Salim Prodhan to contest for the post of chairman in the upcoming Rupganj Upazila Parishad elections of Narayanganj.
Justice M Enayetur Rahim passed the order following a petition filed by local Awami League leader and Prodhan's rival candidate Habibur Rahman challenging the HC order.
