Move aimed at enhancing independence, functionality of judicial branch

CJ proposes separate secretariat for separation of judiciary

Chief Justice Syed Refaat Ahmed has sent a proposal to the Law Ministry recommending for the establishment of a separate secretariat for the judiciary in line with the Supreme Court verdict on Masder Hossain case, known as separation of judiciary case.

Supreme Court administration in a press release on Sunday said the Chief Justice had earlier made the proposal in his speech on September 21 while addressing all judges, lawyers and judicial officials from across the country at the inner garden of the Supreme Court in Dhaka.

The Chief Justice shared a roadmap for judicial reforms in his speech on September 21 at the Supreme Court's main building. This move aimed at enhancing the independence and functionality of the judicial branch, the press release said.

The event was attended by the interim government's Law Adviser Asif Nazrul, Supreme Court judges, Judicial Reform Commission head and former Appellate Division Justice Shah Abu Naeem Mominur Rahman, Attorney General Md Asaduzzaman, and leaders of the Supreme Court Bar Association.

In his address, the Chief Justice emphasised the importance of judicial independence and institutional separation.

"This proposal, crafted with input from both divisions of the Supreme Court, seeks to establish an independent secretariat for the judiciary to ensure transparent governance for lower court judges," the statement read.

The proposal highlights the urgent need for a dedicated judicial secretariat to address increasing caseloads and administrative duties.     

It stated that a separate secretariat would enable greater transparency in judicial discipline, transfers, promotions, and other administrative matters, thereby ensuring the judiciary's true independence.

After the establishment of the judicial secretariat, the Chief Justice said, one of the tasks to bring about qualitative change in the judiciary would be to ensure the appointment of judges on the basis of merit, honesty and efficiency, going beyond personal likes and dislikes.

Ensuring the financial independence of the judiciary is one of the prerequisites for an independent judiciary, according to the statement.
