The High Court is set to deliver the final verdict on Tuesday (December 17) on writ petition challenging the legality of the 15th amendment to the constitution that abolished the non-party caretaker government system.
On December 5, the HC bench of Justice Farah Mahbub and Justice Debashish Roy Chowdhury after concluding hearings on the petition set December 17 ate for announcement of judgment.
On August 19, the High Court asked the government to explain why abolishing the caretaker system should not be declared illegal, after hearing the petition filed by five citizens.
The five citizens are -- Badiul Alam Majumdar, secretary of Shushashoner Jonno Nagorik, and Tofail Ahmed, M Hafizuddin Khan, Md Jobirul Hoque Bhuiyan, and Zahrah Rahman.
Additionally, on October 29, The HC bench led by Justice Farah Mahbub issued a separate rule following a writ filed by Mofazzal Hossain, a freedom fighter from Narayanpara, Naogaon, challenging the validity of 17 provisions of the 15th amendment.
It also questioned why these provisions should not be declared inconsistent with the constitution.
Meanwhile, the 15th amendment to the constitution was introduced during the Awami League government, with the bill passed on June 30, 2011, and a gazette published on July 3, 2011.
The amendment abolished the caretaker government system and increased the number of reserved seats for women in parliament from 45 to 50.
