HC dismisses petition challenging legitimacy of interim govt

The High Court (HC) on Monday rejected a writ petition challenging the oath-taking of the interim government after obtaining permission from the Supreme Court under Article 106 of the Constitution. The HC bench also observed that the people of Bangladesh have accepted the interim government as legitimate, leaving no room for dispute over its legality, as it was formed based on the Supreme Court's opinion under Article 106 of the Constitution.

The HC bench, comprising Justice Fatema Najib and Justice Sikder Md Mahmudur Razi, issued the order and observation while rejecting the writ petition filed to challenge the oath of the interim government.

However, petitioner lawyer Mohsin Rashid told reporters that he would file an appeal with the Supreme Court against the HC order.

Earlier, on 1 December, lawyer Mohsin Rashid filed this writ petition in the High Court. He challenged the oath-taking of the interim government under Article 106 of the Constitution.

On 8 August, the opinion of the Appellate Division of the Supreme Court was sought before the formation of the interim government led by Nobel laureate Dr Yunus. On that day, the then Chief Justice Obaidul Hassan and seven other Appellate Division judges provided a special reference in favour of forming an interim government.
