Govt issues gazette of Legal Aid Services Ordinance

The government has issued the Legal Aid Services (Amendment) Ordinance, 2025, formally amending the Legal Aid Services Act of 2000 to expand access to justice for disadvantaged individuals across Bangladesh.

The ordinance redefines legal aid as the provision of legal advice and assistance to those who are financially insolvent, helpless, or unable to pursue justice due to socio-economic challenges. This applies to cases that are pending, have already been filed, or are yet to be filed in court.

It also introduces provisions for paying honorariums to mediators, including special mediators, appointed to resolve disputes through mediation in line with the Code of Civil Procedure, 1908, and other prevailing laws. Additionally, the ordinance authorizes coverage of case-related costs, legal advice and information for applicants, and mediation services for both pre-litigation and court-referred disputes.

The updated law enhances the role of the National Governing Body, which will be chaired by the minister or adviser of the Ministry of Law, Justice and Parliamentary Affairs. The body will include representatives from relevant ministries, the judiciary, legal institutions, law enforcement, civil society organizations, and rights-based groups, aiming to ensure effective coordination and oversight of legal aid activities.

The executive director of the National Legal Aid Services Organization will serve as the member secretary of the governing body by virtue of the position.

Officials said the ordinance reflects the government's broader effort to strengthen legal institutions and ensure justice for vulnerable communities. It comes as part of a wider series of reforms focused on improving transparency, accountability, and inclusive service delivery across public sectors.
