In Rajshahi-5 (Puthia-Durgapur) constituency, BNP candidate and former MP Nadim Mustafa is going to be missing from 11th parliamentary election.
On Monday, a division bench of the High Court issued a rule asking why the candidature of Nadim Mostafa will not be canceled. The High Court ordered the returning officer to allocate the sheaf of paddy symbol to the district vice-president Nazrul Islam Mondal.
Barrister Abu Bakar Siddique, who took part in the hearing of the writ petition challenging the validity of Nadim Mustafa's candidature, confirmed the information. Nazrul Islam Mondol filed a petition on December 12 challenging the validity of Nadim Mostafa's candidature.
Barrister Abu Bakar said the hearing was held on the bench of Justice JBM Hassan and Justice Khairul Alam. Advocate Anjuman Ara Begum took part in favour of Nadim Mustafa.
Nadim Mustafa said, "I will appeal to the chamber court against the order passed against me by the high court. For this, we have left for Dhaka. I hope the High Court ruling will be postponed and I will be a candidate."
On December 2, the candidature of Nadim Mostafa was canceled by the Returning Officer after the scrutiny.
Nadeem Mustafa appealed against the cancellation of his nomination papers. The appeal was declared valid for his candidacy. But earlier, the final nomination letter of the party was given to Nazrul Islam Mandal.
He submitted the letter of the final nomination to the Returning Officer. But on the day of symbol allocation, the party issued another letter to Nadim Mustafa as the party candidate.
