Detention beyond 24 hours to be treated as enforced disappearance

Detaining a person for more than 24 hours, keeping them at a secret location or denying them legal protection will be considered enforced disappearance, International Crimes Tribunal Chief Prosecutor Md Aminul Islam said on Monday.

He made the remarks while responding to questions from journalists at his office.

Aminul said the Enforced Disappearance Prevention and Redress Act has been passed by Parliament. Under the law, concealing a person’s whereabouts after arrest or detention, holding them at an undisclosed location or denying them legal rights will constitute a separate criminal offence.

He said enforced disappearance would also be treated as a crime against humanity if it is committed on a widespread scale or as part of a systematic pattern.

In such cases, the offences would be tried by the International Crimes Tribunal, he added.

Welcoming the new law, the chief prosecutor said it has opened a new avenue for the families of victims of enforced disappearance to seek justice and expanded the scope for prosecution.

He said the new law does not conflict with the International Crimes Tribunal Act or other existing laws.

Aminul described the legislation as clear and said its implementation would create an opportunity for the families of victims to obtain justice.
