Court orders Viqarunnisa election within 90 days

The High Court has ordered the Viqarunnisa Noon School and College authorities to hold the governing body election within 90 days and issued a rule questioning the legality of its current ad hoc committee.

The rule asks why the ad hoc committee headed by Prime Minister’s Adviser Ismail Zabiullah should not be declared illegal.

The bench of Justice Khizir Ahmed Chowdhury and Justice AFM Saiful Karim passed the order on Tuesday after hearing a writ petition filed in the public interest.

Supreme Court lawyer Md Yunus Ali Akand, who filed the petition on August 13, represented the petitioner at the hearing. Deputy Attorney General Mahfuz Bin Yusuf represented the state.

The petitioner said the 2024 rules governing ad hoc committees require an election to be held within six months. If an election cannot be held within that period, the tenure may be extended for another six months, but the same person cannot serve as chairman during the second extension.

According to the petition, Ismail Zabiullah has been appointed chairman of the Viqarunnisa Noon School and College ad hoc committee for a third consecutive term, in violation of those provisions.

The education secretary, director general of the Directorate of Secondary and Higher Education, chairman and college inspector of the Dhaka Education Board, chairman of the college’s ad hoc committee and its principal were made respondents in the writ petition.
