A court in Patuakhali has taken a suo motu case over a brawl between two groups at the veranda of the Patuakhali Chief Judicial Magistrate Court and ordered an investigation to identify those involved and submit a report within 15 days.
Senior Judicial Magistrate of Patuakhali Amli Court took the case suo motu under Section 190(1)(c) of the Code of Criminal Procedure on Monday (October 5). The court fixed October 25 for submission of the investigation report.
According to the court order, a video circulated on YouTube and social media showed several people engaged in a scuffle at the veranda of the Chief Judicial Magistrate Court. The footage also showed two women fighting and a child present at the scene.
The court observed that such an incident in an area used by litigants, lawyers and court-related personnel raises concerns over the dignity and security of the court. However, the identities of those involved, the cause of the altercation, whether they were parties to any case, whether anyone was injured and the nature of any offence could not be confirmed from the video alone.
The order said the incident could constitute an affray under Sections 159 and 160 of the Penal Code or, depending on the circumstances, offences under Sections 323, 324 and 506, among others. However, the court said no definite conclusion could be reached without an investigation.
The officer-in-charge of Patuakhali Sadar Police Station was directed to conduct the investigation himself or assign it to a police officer not below the rank of sub-inspector. The court also instructed police to seek assistance from female officers if necessary, considering the involvement of women in the incident.
The investigation has been ordered to establish the time, origin and sequence of the incident, identify those involved, determine whether they are connected to any pending court cases, collect medical certificates of injured persons, and obtain CCTV footage from the court and surrounding areas along with relevant videos.
Investigators were also instructed to record statements from eyewitnesses and establish the identity of the child present at the scene and whether the child was exposed to any risk or harm.
Copies of the court order were directed to be sent to the Sadar police station OC, the police superintendent and the court inspector. The Chief Judicial Magistrate was also to be informed.
Patuakhali Public Prosecutor Advocate Mujibur Rahman Toton said the court premises should remain a safe and disciplined place and that disorderly or unlawful activities there would not be tolerated.
Patuakhali Sadar Police Station OC Md Moniruzzaman said the case documents had not yet reached the police station and that legal action would be taken in accordance with the court's directions once they were received.
