A Dhaka court on Wednesday denied bail to Gazi Nazrul Islam, a lawmaker from the Satkhira-4 constituency, in a case filed over the alleged abetment of the suicide of his second wife, Mariam Khatun.

Metropolitan Magistrate Ariful Islam passed the order after a hearing. State prosecutor Harun-or-Rashid confirmed the matter.

During the hearing, defence lawyer Mahbubur Rahman sought bail for Nazrul on the basis of a settlement reached between the parties. The prosecution, however, opposed the bail petition.

Mariam’s father and plaintiff in the case, S M Masum Billah, submitted a settlement document to the court and said he had no objection to Nazrul being granted bail.

However, after hearing both sides, the court rejected the bail petition.

Mariam, 19, was found hanging at a flat in NAM Bhaban in the Sher-e-Bangla Nagar area of Dhaka on September 20. Police recovered her body from Flat 203 on the third floor of Building No. 5.

Following the incident, her father filed a case with Sher-e-Bangla Nagar Police Station accusing Nazrul, his first wife Maksuda Islam and his brother-in-law Obaidur Rahman of abetting her suicide.

After his arrest, Nazrul was initially placed on a four-day remand on September 21, while Maksuda was granted one day of remand. Maksuda was sent to jail on September 22 after the remand. Obaidur was also sent to jail on September 23.

Nazrul was again placed on a four-day remand on September 24 after completion of his initial remand. Meanwhile, a Dhaka court granted bail to Maksuda on September 30.

According to the case statement, Mariam had married Nazrul in June under Islamic law. As Nazrul was an MP, he, Mariam and his first wife lived in a flat at NAM Bhaban opposite the Parliament complex on Manik Mia Avenue.

The plaintiff alleged that Mariam had informed her family by phone on several occasions that Nazrul and his first wife subjected her to physical and mental abuse over various issues after the marriage.

The case statement said Nazrul called Mariam’s father around 5:30pm on September 20 and asked him to come to their residence immediately. Upon arriving, he found several people gathered at the flat and was informed that Mariam was hanging from a ceiling fan with a urna inside a room.

With the assistance of police, the door was broken open and Mariam’s body was recovered. A handwritten suicide note was also reportedly found on the bed.

The plaintiff alleged that Mariam took her own life after being unable to endure the alleged physical and mental abuse and under the alleged instigation of the accused.

Previous Controversy

Nazrul had come under intense public scrutiny in July after several videos allegedly showing intimate moments between him and Mariam circulated on social media.

Following the controversy, the Bangladesh Jamaat-e-Islami expelled Nazrul from the party on July 22, saying an organisational investigation had found evidence of moral misconduct. The party said the decision was taken under Article 62 of its constitution and that the Election Commission was informed.

On July 21, Obaidur Rahman, who was also described as Nazrul’s driver and Mariam’s maternal uncle, filed another case with Pallabi Police Station, alleging that Nazrul had attempted to assault and strangle him over his protest against the alleged relationship and suspicion that he had leaked the videos.

The High Court granted Nazrul an eight-week bail in that case on August 10.

Obaidur, the plaintiff in that earlier case, was subsequently named as an accused in the case concerning Mariam’s death.
