The Riversi Doctrine and Future of the Ganges Water Treaty

December 2026 will mark more than another diplomatic milestone in South Asia. It will present Bangladesh and India with a consequential choice over the future governance of one of the region’s most important transboundary river systems. As the 1996 Ganges Water Sharing Treaty approaches the end of its thirty-year term, the two countries must decide whether to renegotiate only the arithmetic of dry-season allocation at the Farakka Barrage or to rethink the architecture of transboundary water governance itself.

The 1996 treaty addressed an immediate political crisis by establishing a predictable framework for sharing the Ganges’ dry-season flows. Yet three decades later, a fundamental structural limitation has become increasingly apparent: the treaty allocates water between states, but it does not define how much water the river itself requires to remain ecologically functional. Any successor framework must operate in a reality shaped by climate volatility, ecological stress, changing hydrology, and mounting pressure on river-dependent communities.

To remain viable, the next agreement must move beyond distributive bargaining. It requires the application of what I call the Riversi Doctrine: a framework that treats a transboundary river not merely as a divisible geopolitical resource, but as an interconnected ecological continuum whose functional survival must place limits on political allocation.

The Limits of the 1996 Architecture 
The existing treaty rests on a hydrological baseline drawn from an earlier climatic era. Its indicative schedule was constructed using average ten-day flow availability at Farakka between 1949 and 1988. Although the allocation mechanism operates against actual water availability, the assumptions underlying the framework reflect twentieth-century hydrological conditions that may no longer adequately represent present realities.

Climate variability, Himalayan glacial retreat, sediment dynamics, and upstream engineering now interact in ways that a fixed historical baseline cannot fully capture. A July 2026 analysis by the Indian Council of World Affairs argued that changing hydrology and climate uncertainty should therefore be central considerations in any successor framework.

The deeper challenge, however, is ecological. A treaty can be implemented precisely in volumetric terms at Farakka while the wider river system continues to deteriorate. A country’s ten-day allocation can be delivered even as downstream distributaries in Bangladesh lose hydraulic connectivity, salinity intrusion intensifies, and dry-season freshwater availability in the Sundarbans becomes increasingly constrained. The relevant policy metric can therefore no longer be limited to how much water crosses a political boundary. It must also consider whether the river retains sufficient flow to sustain its ecological functions from source to sea.

The Riversi Doctrine
Reversing the Sequence Conventional hydro-diplomacy tends to privilege what governments can most easily quantify: cubic feet of water per second. Ecological deterioration is more difficult to incorporate into negotiations because its costs to agriculture, fisheries, ecosystems, and public health often accumulate gradually rather than appearing as a single political crisis.

The Riversi Doctrine reverses this sequence. Its central proposition is straightforward: before states determine how much water they may withdraw or allocate, they should first establish the minimum hydrological conditions required to maintain the river’s ecological functionality. Under this approach, the primary calculation is neither Bangladesh’s share nor India’s share. It is the jointly assessed environmental-flow requirement of the river system.

Only after establishing a scientifically defensible environmental-flow envelope should the remaining allocable volume be distributed for domestic, agricultural, industrial, and other human uses. This does not displace legitimate human needs. Rather, it recognizes that those needs ultimately depend on a functioning river system. Water security, in this framework, becomes sustainable only when political allocation respects ecological thresholds.

Ecological Reality Meets Domestic Geopolitics
The ecological stakes are measurable. Research has repeatedly identified the Gorai River as a principal freshwater conduit for southwestern Bangladesh, where declining dry-season flows are closely associated with salinity intrusion and wider ecological stress across the delta. The same systems logic applies upstream. India, too, faces the consequences of disrupted river connectivity.

In August 2026, the Indian government reported that the Farakka Barrage, commissioned in 1975, had severely disrupted the historical migration of Hilsa into the upper Ganges. Recent efforts to improve fish passage, together with reported reappearances of the species farther upstream in Uttar Pradesh, illustrate a broader principle: infrastructure, river flow, and ecological connectivity cannot be governed as entirely separate issues.

Implementing the Riversi Doctrine also requires recognising that transboundary diplomacy is inseparable from domestic politics. Dhaka negotiates with New Delhi, but Indian water policy is shaped by the country’s federal structure and the interests of individual states. In February 2026, the Indian government informed the Lok Sabha that West Bengal’s industrial and drinking-water requirements formed part of the treaty consultations. By September 2026, India’s External Affairs Minister had publicly assured Bihar that its domestic water needs would be taken into account during the renewal process.

For Bangladesh, securing downstream ecological viability therefore means negotiating within a basin where several Indian jurisdictions have their own legitimate claims on a finite and increasingly stressed resource. Any durable framework must account simultaneously for bilateral negotiation, domestic federal constraints, and basin-wide hydrological realities.

An Actionable Policy Framework for 2026 
The approaching deadline creates an understandable incentive for negotiators to prioritise continuity and avoid a legal vacuum. Yet simply reproducing the 1996 formula would leave many of the treaty’s structural limitations unresolved. A successor agreement informed by the Riversi Doctrine should institutionalise four reforms: 

Joint Ecological Flow Thresholds: Move beyond exclusive reliance on the 1949�"1988 baseline by incorporating dynamically assessed environmental-flow requirements based on contemporary hydrology, sediment transport, ecosystem needs, and salinity thresholds. The agreement should establish a jointly recognized “ecological floor” beneath the allocation system.

Predetermined Scarcity Rules: Scarcity-sharing arrangements cannot create water that does not exist. The treaty should establish predetermined drought-response bands and allocation procedures rather than relying primarily on improvised and politically sensitive emergency consultations when flows fall sharply.

Cross-Border Ecological Monitoring: Measurements at Farakka should be integrated with data from Hardinge Bridge and downstream indicators, including conditions in the Gorai River system. The evaluative framework should move beyond measuring only “water released” and begin assessing ecological outcomes across the connected basin.

Transparent Verification: The Joint Rivers Commission should be equipped with mechanisms for timely, transparent, and jointly verifiable data exchange. Reducing uncertainty over hydrological information would also reduce the risk that technical discrepancies escalate into disputes over sovereignty and compliance.

If the 2026 negotiations remain exclusively focused on distribution, ecological deterioration may continue to generate political friction. Upstream withdrawals can intensify downstream concerns, while severe droughts can turn hydrological scarcity into questions of national interest and sovereignty. An ecological baseline changes the structure of that debate. It does not eliminate national interests; rather, it identifies a foundational interest shared by both countries. A river that retains sufficient ecological flow can continue to support agriculture, fisheries, navigation, ecosystems, communities, and economies across political boundaries. A river pushed beyond its ecological limits, by contrast, eventually transmits environmental and economic costs across those same boundaries. The defining question for negotiators in December 2026 is therefore not simply: How much water belongs to Bangladesh, and how much belongs to India? A more fundamental question must come first: How much water must remain in the Ganges so that there is still a river worth sharing?
