Delhi HC seeks Salman Khan’s response in film release case

The Delhi High Court has sought Bollywood actor Salman Khan’s response to a petition challenging its jurisdiction to hear his plea to stop the release of Kala Hiran: Battle for Legacy, a film reportedly based on the blackbuck poaching case linked to him.

A bench of Justice Tejas Karia issued notice on Friday, October 9, seeking Khan’s reply to a petition filed by the film’s producer, Amit Jani. The next hearing is scheduled for December 16.

Jani has argued that the Delhi High Court lacks territorial jurisdiction to hear and decide Khan’s plea to block the film’s release and that the case should therefore be dismissed.

The producer’s lawyer told the court that Khan lives in Mumbai while Jani resides in Meerut, Uttar Pradesh. Neither party lives or conducts business within the Delhi High Court’s jurisdiction, the lawyer argued. He also contended that the film’s teaser, posters and promotional materials being available in Delhi, as elsewhere in the country, were not sufficient to establish the court’s jurisdiction.

Khan had earlier approached the High Court seeking to stop the film’s release and promotion. He alleged that the film draws on the high-profile 1998 blackbuck poaching case and events from his life, including his name, mannerisms, speech and references to his iconic films.

Khan has claimed that he was acquitted in three of the four cases related to the alleged poaching, while appeals in the remaining proceedings are pending before the Rajasthan High Court and the Supreme Court. He argued that a dramatic portrayal of the legal proceedings could undermine his right to a fair trial.

The actor also objected to the film’s teaser, alleging that it portrayed him as a criminal.

The producer’s petition has now brought the dispute over the proposed release into a separate legal contest over the High Court’s territorial jurisdiction.
