Full verdict reviving caretaker govt published

The Appellate Division of the Supreme Court of Bangladesh has published the full text of its verdict reviving the constitutional provision for a Non-Partisan Caretaker Government, a development legal experts say could have significant implications for the future electoral framework of the country.

The 74-page judgment was uploaded to the official website of the Supreme Court of Bangladesh on Sunday. The verdict was authored by the then Chief Justice Syed Refaat Ahmed. The Appellate Division had earlier delivered the judgment on November 20.

According to the ruling, the constitutional provision relating to a non party caretaker government system has been revived, although the mechanism will not come into immediate effect. Legal interpretation suggests that the provision may become operational from the 14th parliamentary election of the Jatiya Sangsad.

The caretaker government system was originally incorporated into the Constitution through the Thirteenth Amendment to the Constitution of Bangladesh in 1996, establishing a framework for a neutral interim administration to oversee general elections. Lawyers observing the case said the latest ruling effectively reinstates that constitutional mechanism and may pave the way for more credible and impartial elections in the future.

The verdict also revisits the earlier decision of the Appellate Division delivered in 2011, which had declared the Thirteenth Amendment unconstitutional and void. In the latest judgment, the apex court allowed the appeals and disposed of the review petitions, thereby overturning the earlier position.

The judgment states that the appeals were allowed unanimously and the review petitions were disposed of accordingly. "It is clearly evident from the record that the judgment of the Appellate Division of 2011 is flawed in several ways. Therefore the judgment under review is set aside in its entirety," the court observed.

The ruling further clarified that the constitutional provisions inserted under Part IV, Chapter 2A of the Constitution relating to the non- party caretaker government stand revived as a consequence of the judgment. "The provisions of Part IV of the Constitution, Chapter 2A relating to the Non- Party Caretaker Government inserted by Section 3 of the Thirteenth Amendment Act of 1996 have been revived and activated through this judgment," the verdict states.

However, the court also emphasised that the restored provisions would operate prospectively rather than retrospectively. The judgment specifies that the reinstatement will automatically ensure the restoration of the relevant provisions governing the caretaker administration but that their implementation will remain subject to the application of the revived Articles 58B(1) and 58C(2) of the Constitution.

"The provisions relating to the non- partisan caretaker government mentioned in the reinstated Chapter 2A shall be effective only on a prospective basis," the judgment noted.

The verdict was delivered unanimously by a seven member bench of the Appellate Division headed by the then Chief Justice Syed Refaat Ahmed. The other members of the bench included Justice Md Ashfaqul Islam, Justice Zubair Rahman Chowdhury, who currently serves as Chief Justice, Justice Md Rezaul Haque, Justice S M Emdadul Haque, Justice A K M Asaduzzaman and Justice Farah Mahbub.

Court officials said the judges had entered the courtroom around 9.30 am on the day of the verdict, after which the Chief Justice announced the summary of the decision before the full bench.
