A court in Rajbari has sentenced a 40-year-old man to life imprisonment for raping a woman on the promise of marriage, ordering him to pay Tk 5 lakh in compensation and directing the state to bear the maintenance costs of the child born from the assault until the child turns 21.
Judge Md Tohidul Islam of the Women and Children Repression Prevention Tribunal and District and Sessions Judge Court in Rajbari delivered the verdict on Sunday, October 11.
The convict, Faruk Hossain, son of Ahmad Kha of Nishchintapur village in Pangsha upazila, has been absconding since securing bail.
According to the court verdict, the victim, Mosammat Rekha Khatun, is a divorced woman who lived near Faruk. He had repeatedly proposed marriage to her.
On May 30, 2018, Faruk took her to a relative’s house near Khoksa railway station on the promise of marriage and raped her there. He allegedly continued to have sexual relations with her on the same promise while keeping her at the house for about two months and later at a residence in Dhaka.
When Rekha became pregnant and asked for marriage documents, Faruk denied that they had married and allegedly subjected her to physical and mental abuse.
She managed to leave the residence on September 29, 2018, and returned home. After a local mediation effort, she attempted to file a case with the police but failed. She subsequently filed a complaint with the Women and Children Repression Prevention Tribunal, following which the court ordered Pangsha Police Station to register the case.
The investigation confirmed her pregnancy through medical examinations. She later gave birth to a son, Rafiul Hossain. Police subsequently submitted a charge sheet against Faruk.
The court found the rape charge proved beyond reasonable doubt and sentenced Faruk to life imprisonment with hard labour, along with a fine of Tk 5 lakh. In default of payment, he will serve an additional year of rigorous imprisonment.
The verdict directed that the fine be paid to the victim as compensation. If the amount cannot be recovered from Faruk’s current assets, it may be recovered from assets acquired in the future.
The court also recognised Rafiul as Faruk’s biological son and ordered that his legal rights as the convict’s child be ensured. The state will bear the child’s maintenance costs until he turns 21, after which the government may recover the expenditure from Faruk.
The court directed the district magistrate of Rajbari to determine the maintenance amount and take the necessary steps to implement the order.
The verdict further stated that the sentence warrant would be executed if Faruk is arrested or surrenders.
Lawyer Zahid Uddin Molla, representing the complainant, said the plaintiff’s side was satisfied with the verdict.
