Defamation case against Journo Apu dismissed after 9yrs

A Dhaka court has dismissed a Tk 150 million defamation case filed against journalist Apu Khandaker over a news report, bringing an end to the nine-year-old legal battle.

Chief Metropolitan Magistrate Ismail Hossain passed the dismissal order on Monday, noting that the information presented by the plaintiff lacked a factual basis, according to court sources.

The case, CR No. 1294/2017, was filed in 2017 by Mina Malek, wife of then Dhaka-20 lawmaker MA Malek and a central leader of Bangladesh Jubo Mohila League. She sought Tk 150 million in compensation, alleging that a report published by Apu had defamed her.

Apu served as the Dhaka district correspondent of private television channel 'Channel 9' from 2013 to 2019. He currently works as Dhaka Division in-charge (multimedia) at Kaler Kantho, one of Bangladesh’s leading newspapers.

After the dismissal, Apu said he had been subjected to a prolonged legal process for publishing a report in the public interest. He said reporting on matters of public interest is a journalist’s professional responsibility and that he finally received justice through the court’s order.

Senior lawyer Advocate Rafiqul Islam Shihab, who represented Apu, welcomed the decision, saying, “We are pleased that the court has delivered justice by dismissing the case.”
