Asif Mahmud sends legal notice to ACC official

NCP spokesperson Asif Mahmud Sajib Bhuiyan has sent a legal notice seeking the withdrawal of a statement by an Anti-Corruption Commission official that there was “initial truth” in corruption allegations against him.
Supreme Court lawyer Muhammad Rafiqul Islam Jony, representing Asif Mahmud, sent the notice to ACC public relations officer and deputy director Akhtarul Islam on Thursday, according to a press release issued on Friday.
At a press conference on September 2, Akhtarul Islam said the ACC had found “initial truth” in allegations of irregularities involving transfers, appointments and promotions related to Asif Mahmud.
The statement was subsequently widely reported by the media and circulated on social media.
According to the press release, Asif Mahmud’s lawyer said the statement, made without an investigation or specific evidence, led to what amounted to a media trial and created an impression among the public that the allegations had already been proven, damaging his personal and political reputation.
The release said Akhtarul Islam later told journalists in the ACC beat WhatsApp group that the statement had been made mistakenly and requested that the phrase “initial truth” be omitted from reports. However, the statement made at the press conference was not formally withdrawn or corrected.
The legal notice also pointed to factual discrepancies in the allegations. It said 112 upazila youth development officers, rather than 38 as alleged, had their additional responsibilities cancelled in implementation of an order of the Administrative Appellate Tribunal.
It also said allegations linking Asif Mahmud to the promotion of 150 assistant upazila youth development officers to upazila youth development officer posts were baseless. Asif Mahmud resigned as adviser on December 10, 2025, while the promotions took place on May 11, 2026, five months after his resignation and three months after the BNP government took office.
The notice asked Akhtarul Islam to unconditionally withdraw his statement in the same manner within 15 days and refrain from making statements in future without verified and evidence-based information.
It warned that legal action would be taken against him under Section 500 of the Penal Code and other applicable laws if he failed to comply within the stipulated period.
