Dhaka court settles Tk 30 lakh compensation for man wrongfully jailed

A man who spent nearly four months in jail due to mistaken identity in a cheque dishonour case has received Tk 3 million in compensation following an unconditional apology from the complainant.

The court of Dhaka Fourth Joint Metropolitan Sessions Judge Tania Sultana Lipi accepted the settlement on Thursday, July 23 after both parties filed a joint compromise petition.

The victim, Mamun Mia, withdrew his complaint after receiving the compensation from Biswas Poultry & Fish Feeds Ltd., whose representatives admitted their mistake.

Mamun said he was wrongfully imprisoned simply because his name matched that of the actual accused.

His lawyer, Advocate Sadekul Islam Bhuiyan Jadu, said the managing director of the company tendered an unconditional apology, paid the compensation, and assured that such an error would not happen again.

Company representative Maksudul Haque Walid said the incident occurred due to mistakes by several officials. He added that administrative action has been taken against them, and they have been temporarily relieved of their duties.

According to court records, the case was filed in 2019 under the Negotiable Instruments Act over a bounced cheque worth Tk 3.2 million.

Following a conviction in 2025, police arrested Mamun on February 5, 2026, under an arrest warrant, despite him having no connection to the cheque or the bank account.

A court-ordered investigation later confirmed that police arrested him solely due to a name match with the actual convict. The court acquitted him on May 19, and he was released from Dhaka Central Jail the following day.

After his release, Mamun sought compensation and legal action against those responsible. The issue has now been resolved through the apology, compensation, and a court-recorded settlement.
